    2017 Income Limits

    Most individual debtors filing for bankruptcy relief are required to complete a version of Bankruptcy Form 122 and will be asked to fill in the median income for their states and sizes of household as part of the bankruptcy means test. State median income data is published by the United States Census Bureau and, pursuant to 11 U.S.C. § 101(39A)(B), is further adjusted early each calendar year based upon the Consumer Price Index for All Urban Consumers (CPI).

    The state median income can have a significant impact on a Chapter 7 bankruptcy case because there is a presumption of abuse of the Bankruptcy Code for debtors whose current monthly income exceeds the state median. Such presumptions, however, can be overcome if the debtor has primarily consumer debts, qualifies for a military service provision, or has other types of certain expenses that diminish his or her current monthly income.

    Ohio 2017 Income Limits

    According to the Census Bureau, the median family incomes by family size for cases filed in Ohio on or after May 1, 2017 are as follows:

    Debtors can add $8,400 for each individual added to the family size in excess of four.

    Kentucky 2017 Income Limits

    The Census Bureau has established the following median family incomes by family size for cases in Kentucky filed on or after May 1, 2017:

You can also learn more about National Standards for minimum allowances for five necessary expenses (food, housekeeping supplies, apparel and services, personal care products and services, and miscellaneous) as well as out-of-pocket health care expenses including medical services, prescription drugs, and medical supplies (e.g. eyeglasses, contact lenses, etc.). The standards are derived from the Bureau of Labor Statistics (BLS) Consumer Expenditure Survey (CES).
