Steiden Law Offices | Hamilton County, OH

Hamilton County is one of the largest counties in Ohio. With a population of 845,303, the county is home to a large concentration of both people and businesses. It includes well-known schools, such as Xavier University and the University of Cincinnati, beautiful parks like the Miami Whitewater Forest, and corporate headquarters for major companies like Procter and Gamble, Cintas and AK Steel.

Considering the importance of Hamilton County in both the state of Ohio and our nation in general, many have set up residence in this area to take advantage of the countless opportunities available. This includes many cases of starting businesses or investing in a home. Although it would be nice to see everyone succeed at what they do, in a competitive society, this is never the outcome. Where a few succeed, many are less fortunate. This breakdown can be devastating to those who simply wanted to accomplish their life goals and live their own version of the American Dream.

Fortunately, there are solutions to this financial hole that many find themselves in. The resolution for individuals and businesses saddled with debt may be in the form of bankruptcy protection. Filing for bankruptcy allows you to either liquidate or restructure your debt in the hopes that you can learn from the mistakes you have made and start over with a clean slate.

Filing for Chapter 13 Bankruptcy in Hamilton County

A Chapter 13 bankruptcy is also called a "wage earners plan." It enables individuals with regular income to develop a plan to repay all or part of their debts. Under this chapter, debtors propose a repayment plan to make installments to creditors over three to five years. If the debtor's current monthly income is less than the applicable state median, the plan will be for three years unless the court approves a longer period "for cause."

Hamilton County Chapter 7 Bankruptcy Lawyer

A Chapter 7 bankruptcy case does not involve a repayment plan as in chapter 13. Instead, the bankruptcy trustee collects and sells the debtor's nonexempt assets and uses the proceeds of such assets to pay holders of claims (creditors). Part of the debtor's property may be subject to liens and mortgages that pledge the property to other creditors. In addition, the U.S. Bankruptcy Code will allow the debtor to keep certain "exempt" property; but a trustee will liquidate the debtor's remaining assets. Potential debtors should realize that the filing of a petition under Chapter 7 may result in the loss of property.
